Terms of Use
# 1.0Acceptance of Terms
By downloading, installing, or using Slackwater — the iOS app or the website at slackwater.app — you agree to these Terms of Use. If you do not agree, do not use Slackwater.
# 2.0Description of Service
Slackwater displays tide predictions, water levels, weather forecasts, wind, weather radar, and sun & moon information for stations along the Texas coast. This information is sourced from third parties, including NOAA CO-OPS, the National Weather Service, the U.S. Naval Observatory, Open-Meteo, and RainViewer, and is presented for general informational and recreational use.
# 3.0Not for Navigation or Safety-of-Life Decisions
Slackwater is for general information and recreation only. Do not rely on it for navigation, marine safety, or any decision affecting life, health, or property.
People use tide and weather information to plan activities that carry real physical risk — including boating, kayaking and paddling, wading, fishing, swimming, and other coastal and on-the-water activities. Tide values are predictions, and weather and water-level data may be delayed, estimated, incomplete, or inaccurate; actual conditions can differ significantly from what is shown. For navigation and any safety-related decision, always consult official sources — including official NOAA tide tables and charts, National Weather Service marine forecasts and warnings, and the U.S. Coast Guard — and use proper equipment and your own judgment.
Assumption of risk. You are solely responsible for your own safety and for any decision you make while using Slackwater. You acknowledge that coastal and on-the-water activities are inherently risky, and you assume all risks associated with your use of the app and the information it presents. To the fullest extent permitted by law, Working Model LLC is not responsible for any injury, loss, or damage resulting from your use of, or reliance on, Slackwater.
# 4.0Data Accuracy and Availability
The data shown in Slackwater is provided by third-party sources and is delivered "as is." We do not create, verify, or guarantee the accuracy, completeness, timeliness, or availability of any tide, weather, or other data. Service may be interrupted or unavailable, and data sources may change, fail, or discontinue without notice.
# 5.0Subscription
The Slackwater website at slackwater.app is free to use. The iOS app is free to download and offers a $4.99 per year auto-renewing subscription, which begins with a 7-day free trial and unlocks full access to the app.
Payment is charged to your Apple ID at the end of the free trial and at the start of each renewal term. The subscription renews automatically at $4.99/year unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel the subscription, including during the free trial, in your Apple ID account settings; cancel at least 24 hours before the trial ends to avoid being charged. Prices may vary by region and are subject to change. The subscription is processed by Apple and is also subject to Apple's terms and refund policies; you can restore an active subscription on any device signed in to the same Apple ID. The website remains free to use without a subscription.
# 6.0License
Slackwater is licensed, not sold, to you. Subject to these terms, you are granted a limited, non-exclusive, non-transferable license to use the app on any Apple device you own or control, as permitted by the App Store Terms of Service, and to use the website for its intended purpose.
# 7.0Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the app
- Use Slackwater or its API for any unlawful purpose
- Access the service through automated means, or in a way that places an unreasonable load on our servers or the underlying data providers, or that interferes with other users
- Misrepresent the data, or redistribute it in a way that violates the terms of the underlying data sources
# 8.0Intellectual Property
Slackwater, including its design, code, and branding, is the intellectual property of Working Model LLC. The underlying tide, weather, and astronomical data is the property of its respective public and third-party sources and remains subject to their terms.
# 9.0Disclaimers
Slackwater is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or available at any given time.
# 10.0Limitation of Liability
To the maximum extent permitted by applicable law, Working Model LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or damage of any kind arising from your use of, or reliance on, Slackwater or the data it presents.
# 11.0Termination
We reserve the right to modify or discontinue Slackwater at any time. Your license to use the app terminates automatically if you fail to comply with these terms.
# 12.0Governing Law
These terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles. Any disputes shall be resolved in accordance with applicable law.
# 13.0Changes to These Terms
We may update these terms from time to time. Continued use of Slackwater after changes constitutes acceptance of the updated terms.
